K\u0130RAYA VEREN\u0130N GEREKS\u0130N\u0130M\u0130<\/strong><\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p><em>Madde 350- Kiraya veren, kira s\u00f6zle\u015fmesini;<\/em><\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p><em>Kiralanan\u0131 kendisi, e\u015fi, altsoyu, \u00fcstsoyu veya kanun gere\u011fi bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu di\u011fer ki\u015filer i\u00e7in konut ya da i\u015fyeri gereksinimi sebebiyle kullanma zorunlulu\u011fu varsa,<\/em><\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Kiraya veren, maddede say\u0131lan ki\u015filerin kullan\u0131m\u0131 i\u00e7in ihtiyac\u0131 olmas\u0131 durumunda a\u00e7aca\u011f\u0131 dava ile ta\u015f\u0131nmaz\u0131ndan kirac\u0131s\u0131n\u0131n tahliye edilmesini sa\u011flayabilir. Kiraya verenin ta\u015f\u0131nmaza ger\u00e7ekten gereksinimi olmal\u0131d\u0131r. \u00d6rne\u011fin, iki ta\u015f\u0131nmaz\u0131 olan birinin, birisinde kendisinin oturmas\u0131 birisini ise kiraya vermi\u015f olmas\u0131 durumunda bu ki\u015fi, kendisinin ihtiyac\u0131 nedeniyle kiraya verdi\u011fi ta\u015f\u0131nmaz\u0131 bo\u015faltamaz. Ancak \u00f6rne\u011fin o\u011flunun evlenmi\u015f olmas\u0131 ve o\u011flunun oturacak ba\u015fka evinin olmamas\u0131 nedeniyle kiraya verdi\u011fi ta\u015f\u0131nmaz\u0131n tahliyesini bu gereksinime dayanarak isteyebilir.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Kiraya veren gereksinim nedeniyle tahliye davas\u0131n\u0131 kira s\u00fcresinin bitimine en az 1 ay kala a\u00e7abilir. Kiraya veren bu s\u00fcre i\u00e7inde dava a\u00e7may\u0131p yaz\u0131l\u0131 bildirimde de bulunabilir. Yaz\u0131l\u0131 bildirimde bulunur ise bir sonraki d\u00f6nem boyunda tahliye davas\u0131n\u0131 a\u00e7abilecektir.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Gereksinim nedeniyle tahliye davas\u0131 a\u00e7\u0131ld\u0131ktan ve bu nedenle kirac\u0131 tahliye edildikten sonra kiraya veren, s\u00f6z konusu ta\u015f\u0131nmaz\u0131 3 y\u0131l boyunca hakl\u0131 bir neden olmaks\u0131z\u0131n eski kirac\u0131dan ba\u015fka bir kirac\u0131ya kiralayamaz. Kiraya veren buna uymazsa, eski kirac\u0131s\u0131na bir y\u0131ll\u0131k kira bedelinden az olmamak \u00fczere tazminat \u00f6demekle y\u00fck\u00fcml\u00fc olacakt\u0131r.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p><strong>1.1.2. YEN\u0130DEN \u0130N\u015eA VE \u0130MAR<\/strong><\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p><em>Kiralanan\u0131n yeniden in\u015fas\u0131 veya imar\u0131 amac\u0131yla esasl\u0131 onar\u0131m\u0131, geni\u015fletilmesi ya da de\u011fi\u015ftirilmesi gerekli ve bu i\u015fler s\u0131ras\u0131nda kiralanan\u0131n kullan\u0131m\u0131 imk\u00e2ns\u0131z ise, belirli s\u00fcreli s\u00f6zle\u015fmelerde s\u00fcrenin sonunda, belirsiz s\u00fcreli s\u00f6zle\u015fmelerde kiraya ili\u015fkin genel h\u00fck\u00fcmlere g\u00f6re fesih d\u00f6nemine ve fesih bildirimi i\u00e7in \u00f6ng\u00f6r\u00fclen s\u00fcrelere uyularak belirlenecek tarihten ba\u015flayarak bir ay i\u00e7inde a\u00e7aca\u011f\u0131 dava ile sona erdirebilir.<\/em><\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Yukar\u0131daki madde uyar\u0131nca ta\u015f\u0131nmazda yeniden in\u015fa ve imar amac\u0131yla onar\u0131m yap\u0131lmas\u0131 i\u00e7in bo\u015falt\u0131lmas\u0131 sa\u011flanan ta\u015f\u0131nmazlar eski haliyle 3 y\u0131l ge\u00e7medik\u00e7e eski kirac\u0131s\u0131ndan ba\u015fkas\u0131na kiralanamaz ve kiralan\u0131r ise kiraya veren, eski kirac\u0131s\u0131na 1 y\u0131ll\u0131k kira bedelinden az olmamak \u00fczere tazminat \u00f6demekle y\u00fck\u00fcml\u00fc olacakt\u0131r. Ayr\u0131ca eski kiran\u0131n, onar\u0131m\u0131 ger\u00e7ekle\u015ftirilen ta\u015f\u0131nmazda yeniden kirac\u0131 olabilmek i\u00e7in \u00f6ncelik hakk\u0131 bulunmaktad\u0131r.Kiraya verenin yapaca\u011f\u0131 yaz\u0131l\u0131 bildirimi izleyen 1 ay i\u00e7inde kirac\u0131 bu hakk\u0131n\u0131 kullanabilecektir.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p><strong>1.1.3. <\/strong><strong>YEN\u0130 MAL\u0130K\u0130N GEREKS\u0130N\u0130M\u0130<\/strong><\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p><em>Madde 351- Kiralanan\u0131 sonradan edinen ki\u015fi, onu kendisi, e\u015fi, altsoyu, \u00fcstsoyu veya kanun gere\u011fi bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu di\u011fer ki\u015filer i\u00e7in konut veya i\u015fyeri gereksinimi sebebiyle kullanma zorunlulu\u011fu varsa, edinme tarihinden ba\u015flayarak bir ay i\u00e7inde durumu kirac\u0131ya yaz\u0131l\u0131 olarak bildirmek ko\u015fuluyla, kira s\u00f6zle\u015fmesini alt\u0131 ay sonra a\u00e7aca\u011f\u0131 bir davayla sona erdirebilir. Kiralanan\u0131 sonradan edinen ki\u015fi, dilerse gereksinim sebebiyle s\u00f6zle\u015fmeyi sona erdirme hakk\u0131n\u0131, s\u00f6zle\u015fme s\u00fcresinin bitiminden ba\u015flayarak bir ay i\u00e7inde a\u00e7aca\u011f\u0131 dava yoluyla da kullanabilir.<\/em><\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Kira s\u00f6zle\u015fmesi devam ederken ta\u015f\u0131nmaz\u0131n ba\u015fkas\u0131na sat\u0131lmas\u0131 durumunda sat\u0131n alan ki\u015fi kira s\u00f6zle\u015fmesinin taraf\u0131 olmaktad\u0131r. Yeni ald\u0131\u011f\u0131 ta\u015f\u0131nmaz\u0131 kullanmaya ihtiyac\u0131 olan yeni malik, ta\u015f\u0131nmaz\u0131 edinme tarihinden itibaren 1 ay i\u00e7inde kirac\u0131ya yaz\u0131l\u0131 bildirimde bulunarak, 6 ay sonra a\u00e7aca\u011f\u0131 tahliye davas\u0131 ile s\u00f6zle\u015feyi sonland\u0131rabilir.6 ayl\u0131k s\u00fcreyi beklerken kira s\u00f6zle\u015fmesinin bitmesi durumunda, 6 ay\u0131 beklemeden kira s\u00f6zle\u015fmesinin bitiminden itibaren 1 ay i\u00e7inde de davan\u0131n a\u00e7\u0131lmas\u0131 m\u00fcmk\u00fcnd\u00fcr.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>\u00d6rne\u011fin, 20.04.2023 ba\u015flang\u0131\u00e7 tarihli kira s\u00f6zle\u015fmesi kiralanm\u0131\u015f olan bir ta\u015f\u0131nmaz\u0131 20.06.2023 tarihinde sat\u0131n alan malik, 20.07.2023 tarihine kadar yaz\u0131l\u0131 bir bildirimde bulunmas\u0131 \u015fart\u0131yla 20.01.2024 tarihinde yeni malikin gereksinimi nedenine dayanan tahliye davas\u0131n\u0131 a\u00e7abilir.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Yeni malik ta\u015f\u0131nmaz\u0131 20.12.2023 tarihinde sat\u0131n alm\u0131\u015f olsayd\u0131, 20.04.2024 tarihinde s\u00f6zle\u015fme sona erece\u011finden, bu tarihten itibaren 1 ay i\u00e7inde 20.05.2024\u2019e kadar a\u00e7aca\u011f\u0131 bir dava ile de s\u00f6zle\u015fmeyi sona erdirebilir. Bu durumda yeni malik i\u00e7in s\u00f6zle\u015fme s\u00fcresinin bitimini beklemek daha avantajl\u0131d\u0131r.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p><strong>1.2. K\u0130RACIDAN KAYNAKLANAN NEDENLER<\/strong><\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p><strong>1.2.1. YAZILI TAHL\u0130YE TAAHH\u00dcD\u00dc VER\u0130LMES\u0130<\/strong><\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Kirac\u0131, kiraya verene kar\u015f\u0131 ta\u015f\u0131nmaz\u0131 belli bir tarihte bo\u015faltmay\u0131 yaz\u0131l\u0131 olarak \u00fcstlenmi\u015fse ve bu tarih geldi\u011finde bo\u015faltmam\u0131\u015fsa kiraya veren, kira s\u00f6zle\u015fmesini bu tarihten itibaren ba\u015flayarak bir ay i\u00e7inde a\u00e7aca\u011f\u0131 dava ile sona erdirebilir. Kirac\u0131n\u0131n tahliye taahh\u00fcd\u00fcn\u00fc ta\u015f\u0131nmaz\u0131n tesliminden sonra vermi\u015f olmas\u0131 gerekmektedir.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p><strong>1.2.2. \u0130K\u0130 DEFA HAKLI \u0130HTAR<\/strong><\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Kirac\u0131, 1 y\u0131ldan k\u0131sa s\u00fcreli kira s\u00f6zle\u015fmelerinde kira s\u00fcresi i\u00e7inde, 1 y\u0131l ve daha uzun s\u00fcreli kira s\u00f6zle\u015fmelerinde ise bir kira y\u0131l\u0131 veya bir kira y\u0131l\u0131n\u0131 a\u015fan s\u00fcre i\u00e7inde kira belini \u00f6demedi\u011fi i\u00e7in kiraya veren taraf\u0131ndan kendisine iki hakl\u0131 ihtarda bulunulmas\u0131na sebep olmu\u015fsa kiraya veren, kira s\u00fcresinin veya 1 y\u0131ldan uzun s\u00fcreli kiralarda ihtarlar\u0131n yap\u0131ld\u0131\u011f\u0131 kira y\u0131l\u0131n\u0131n bitiminden ba\u015flayarak 1 ay i\u00e7inde a\u00e7aca\u011f\u0131 dava ile kira s\u00f6zle\u015fmesini sonland\u0131rabilir.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>\u00d6rne\u011fin, 20.04.2023 ba\u015flang\u0131\u00e7 tarihli 1 y\u0131l s\u00fcreli kira s\u00f6zle\u015fmesinde, kirac\u0131 20.04.2024 tarihine kadar 2 defa kira bedelini \u00f6dememi\u015f veya ge\u00e7 \u00f6demi\u015f ve bu nedenle ihtar alm\u0131\u015f ise kiraya veren, 20.05.2024 tarihine kadar a\u00e7aca\u011f\u0131 dava ile s\u00f6zle\u015fmeyi sona erdirebilir.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>\u0130htar genellikle noterden yap\u0131lmakla birlikte ba\u015flat\u0131lacak icra takibi de ihtar yerine ge\u00e7mektedir.
